Craig M. Nisnewitz

Craig M. Nisnewitz is the Senior Partner of the firm. Mr. Nisnewitz received his J.D. from Hofstra University School of Law in 1981 and B.A. from Queens College of the City University of New York in 1978. He is admitted to practice in the State of New York, Federal District Courts for the Eastern and Southern Districts of New York, and United States Court of Appeals for the Second Circuit. Mr. Nisnewitz specializes in construction law, commercial litigation and information technology.

Over the past twenty years he has represented owners, contractors, subcontractors, architects, engineers, and various suppliers and vendors of construction materials and systems in disputes involving public and private construction projects. He served as General Counsel for two general contractors from 1989 through 1993. As General Counsel, he was responsible for the preparation and review of all contract documents involving private and public construction projects and the preparation, defense of construction claims and supervision of litigation, arbitration proceedings and general corporate matters. He was also responsible for legal matters involving the construction of private and public housing developments. He has also been engaged in private practice with firms that specialize in construction law and commercial litigation. He has prepared and presented construction claims in court and in arbitration and mediation proceedings which involved disputes for additional work, disputed work claims, delay analysis involving the use of CPM (critical path method) scheduling and complex forensic analysis of claims. He also represents clients in the computer hardware and software industry, internet clients, and firms in information technology.

In connection with the presentation of construction claims and the representation of clients, he has appeared before many public agencies including the U.S. Army Corps. of Engineers, New York State Office of General Services, New York State Department of Transportation, New York City School Construction Authority, New York City Metropolitan Transportation Authority, Dormitory Authority of the State of New York and New York City Housing Authority.

Mr. Nisnewitz serves as an arbitrator on the Construction Industry Panel of the American Arbitration Association. Mr. Nisnewitz has tried numerous cases and arbitrated construction and commercial matters before the American Arbitration Association.

Mr. Nisnewitz has argued many appellate matters, including In the Matter of Jaidan Industries, Inc. v. M.A. Angeliades, Inc., 277 A.D.2d 237, 716 N.Y.S.2d 683 mot for lv to app granted 96 N.Y.2d 710, 751 N.E.2d 944, 727 N.Y.S.2d 696, reversed 97 N.Y.2d 659; 763 N.E.2d 1142; 738 N.Y.S.2d 1; 2001 N.Y. LEXIS 3417(Court of Appeals, November 19, 2001), in which New York State Court of Appeals reversed the Appellate Division and held in favor of his client Jaidan that the preparation of engineering shop drawings by a subcontractor that were reviewed by the project architect complied with the requirements of the New York State Education Law.
